You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and that the information you provide is accurate.
The Service is an educational and informational self-assessment and content experience. It helps you reflect on the fit between your own stated preferences ("set points") and your own description of your life, and it shares general research-based information. It is a structured self-reflection tool.
The Service is not a medical device, medical or psychological care, therapy, counseling, diagnosis, or treatment, and it does not provide clinical services of any kind. Care Koo, LLC does not provide healthcare through the Service.

Using the Service does not create a doctor–patient, therapist–client, or any other professional relationship between you and Care Koo, LLC or any individual affiliated with it. Results are estimates based on your self-report and on general research findings; they are not a clinical assessment and are presented as distance from your own stated set points, not as a score of you or a diagnosis. Any statement that aligning how you live with how you are built, as part of a healthy lifestyle, may help support wellbeing or reduce the risk of certain conditions is a general-wellness statement about lifestyle, not a claim that the Service diagnoses, treats, cures, or prevents any disease. The Service has not been evaluated by the U.S. Food and Drug Administration or any other regulatory body.
Accounts are optional and passwordless: we sign you in with a one-time code sent to your email. You are responsible for maintaining access to your email and for activity under your account. Notify us of any unauthorized use. You may delete your account at any time by contacting us.
"Private data." Your assessment answers live only in your browser. If you leave without saving them (for example, as a PDF or to an account), they will not be accessible again later, and they are not kept long-term on our servers. If you would like to access your results in the future, saving them to a free account stores an encrypted copy for you.

We grant you a limited, personal, non-transferable, non-exclusive license to use the Service and your own report for your personal, non-commercial use. All other rights are reserved.
Mention of any institutions does not reflect necessary endorsement by this company, nor does it imply full endorsement of the ideas by that institution.
The Service may link to or rely on third-party services. We are not responsible for third-party content or practices, and your use of them is governed by their terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARE KOO, LLC AND ITS MEMBERS, OFFICERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Care Koo, LLC and its members, officers, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these terms.
We may modify the Service or these terms from time to time. Material changes will be reflected by updating the "last updated" date, and your continued use after changes take effect constitutes acceptance.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury hear your claims.
(a) Agreement to arbitrate. You and Care Koo, LLC agree that any dispute, claim, or controversy arising out of or relating to these terms or your use of the Service, whether based in contract, tort, statute, or any other legal theory, will be resolved by binding individual arbitration, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this agreement to arbitrate. The arbitrator, and not any court, has exclusive authority to resolve any dispute about the interpretation, applicability, or enforceability of this arbitration agreement.
(b) Arbitration procedure. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these terms, and conducted by a single arbitrator in English. Proceedings will be by written submissions or by phone or video conference; any in-person hearing will take place in the State of Florida, unless the AAA's rules require otherwise. The arbitrator's award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
(c) No class actions. You and we each agree that any proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If this class-action waiver is found unenforceable as to a particular claim, then that claim (and only that claim) must proceed in court, and the remainder of this section stays in effect.
(d) Jury trial waiver. To the extent any dispute proceeds in court rather than in arbitration, you and we each waive the right to a trial by jury.
(e) Severability. Except as stated in (c), if any part of this section is found unenforceable, the remaining parts remain in force.
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. For any dispute that is not subject to arbitration under Section 14, the state and federal courts located in Florida will have exclusive jurisdiction, and you and we each consent to venue there, unless otherwise required by applicable law.
